Legal Question in Family Law in Texas
Divorce or ?
I am worried about the well being of my children. My wife will not clean house or take care of our children. She neglects to fulfill the children's nutritional needs. They are often late for school, and rarely dressed appropriately. She screams and shouts obscenities at them. My wife is unemployed, healthy, and without disability. She has stopped all intimate contact with me. We spoke about divorce and she said she would rather stay married and go through the motions. The children have to fend for themselves when I am not home. My 10 year old daughter is suffering especially, speaking of and attempting suicide, doing poorly in school, and displaying alot of aberrant behavior. My youngest (2) has been looking malnourished as well as displaying signs of developmental problems. I hold down a full time job and use what little time I have left to clean and cook. I can not keep going like this. I have done my best to insure the children are well cared for, when I am around, but I have no control once I leave the house for work.
I want custody of my children.
If we divorce,
What can I do to increase my chances at gaining custody?
Could I be liable for any kind of maintenance?
Will I qualify for any type of Child support?

Re: Divorce or ?
You need to be able to prove all these claims. You might require some expert testimony from a child psych or doctor's office. You will have to defend yourself that you did not cause the problems. If you get the children, you would be eligible for child support, but if she doesn't work, she won't be paying anything. You can put her in jail until you're blue in the face, but that's not any money. See a lawyer skilled in these efforts. It will be worth the money in the long run. Many lawyers work on payment plans. Good Luck.
