Legal Question in Family Law in Texas
Divorce/Change of Beneficiaries
In Texas, my ex-husband changed his beneficiaries on his life insurance policy naming only his children during his pending divorce from second wife. Her attorneys said since the premiums were paid with funds considered community property, that she was still entitled to the life insurance proceeds even though her name was no longer on the policy at the time of my ex-husband's death. Is that true? He changed the beneficiaries after he had filed for divorce. I have no idea if any temporary orders were filed preventing him from changing the insurance policy. But he was an attorney himself, so I feel sure he knew whether that could be done or not. She was awarded 75% of the proceeds because my attorneys advised me to do nothing. I would just like to know if she was legally entitled to the proceeds just because the premiums were paid with community funds.

Trying to second guess your attorneys, who were actually in possession of all the facts, is not what this venue is for. If you are not happy with the advise your attorneys gave you, then you need to take all your information and documentation to another attorney and get a valid second opinion.
