Divorce/Child custody

My husband moved out 6 months ago to move in with his business partner over at his dads house. He has not talked to or seen his kids in over a month. He has not been financially supportive and leaves the child care costs to me. I do not have any access to his money. I just got a job, but only make about $500 every 2 weeks. If I were to file for divorce, could I make my husband pay for any attorney fees? Plus what would I ahve to do to get full legal custody of my children? He would rather go to clubs and bars with his business partner than support his children. His new residences is not safe for children and I fear if he gets custody of my kids, they will be forced to live in an unsafe residence. We currently live with my parents who have a safe home. We have been here for almost 2 years.

You need to come visit with me or some other attorney and allow us to get a Court involved in your life. While I cannot make any promises, it seems from the facts you related that a Court may very well order your husband to contribute to attorneys fees or spousal maintenance for you to be able to pay such yourself. You'll just have to visit with a lawyer to get an answer to your question for the courts in your area. Certainly the law allows for him to pay the attorneys fees, but it's not automatic, but for sure, he would be required to pay child support. I don't know why you have let him get by with that for 2 years. Go to a lawyer's office. Good Luck.
