divorce/custody

can divorce and custody be delt with when mother-father live in 2 different states and have not yet filed any papers?

Divorce and custody are legal issues which must be resolved in a court of competent jurisdiction which could be in either state. These issues can only be resolved by "filing papers". Binding agreements can be reached on the subordinate issues of each question prior to filing papers - if that was what you meant.
