Legal Question in Family Law in Texas
How do you go about getting divorced if you are considered common law married? And what is the cheapest and simplest way to go about it?
1 Answer from Attorneys
A common law marriage is just like any other marriage in the State of Texas.
The cheapest is to have an uncontested divorce.
I don't recommend the kits sold on t.v. and radio.
Also, the kits sold in office supply stores are worthless - read the back -- it clearly states that the "state forms are NOT included" -- so why waste your money!
I sell DO IT YOURSELF KITS if the 2 of you agree on everything. How much do they cost? Depends on what you have -- minor children cost more than no kids. Real estate? Costs more than no real estate.

You pay the filing fee to the District Clerk directly. The price to the District Clerk depends on the county you live in - usually under $300.
