Legal Question in Family Law in Texas

not divorced in Mexico

I married my second wife in the U.S. while I was separated from my first wife, whom I married in Mexico. My first wife died in 1994. I want to adopt my grandchildren and I am required to be legally married. Can I get a new marriage certificate with my second wife? If so will I be accused of bigamy? If not can I get a common law marriage certificate?

Re: not divorced in Mexico

Since your first wife is dead, you are not a bigamist.

If your first wife is dead, then you might be now legally married to your second wife.

You can read the Texas Family Code on-line. It covers how an invalid second marriage can become a valid marriage.

You might want to call my office and talk to me.
