To get him to leave, you'll have to ask the court to issue what are called "temporary orders". They basically tell the parties who has to do what while the divorce is going on (who stays in the house, who pays the mortgage and utilities, what money can be taken out of joint accounts, who has to maintain health insurance, who gets custody of the kids and pays child support, and all that). The court will not issue temporary orders unless you ask for them, though, and unless they're agreed, you'll have to request and have a hearing that's kind of like a mini-divorce, so that both of you get a chance to briefly tell the judge what terms you want and tbe reasons why she should grant your version. There's no guarantee, of course, that the judge will order him to move out, but really that's the only way that he can be forced to do so, assuming you don't qualify for a protective order due to domestic violence, and even if that's the case, you still need to have all of those other terms in place to protect your property and any children. Good luck!
