Legal Question in Family Law in Texas

divorced and wanting to move

I am divorced and in my divorce. I am stuck in a certain city/miles. I am wanting to move to a different state. I have been divorced for 2 years. I have join custody of the 2 kids. My ex. is not happy about the idea. And wants to try and stop me. What should I do and could he get custody for my kids? Can he stop me from moving? What is the cost to fight him. I have even thought about letting him stop paying child support. I just want my kids..

Re: divorced and wanting to move

It sounds like you have a residency restriction in your decree. If this is the case and you want to remove it so that you can move with the kids, then you will need to file a motion to modify. The court will apply a "best interests of the children" standard. In reality, there are too many issues involvled in this to address here and you will need to discuss them with an attorney. If you are in my area, call me to discuss further.

Certainly, you can move anytime you get ready. But, I'm sure you want the children to go with you. That would depend upon what is in the best interest of the children. There are too many issues to discuss in this reply. You should discuss these issues with a lawyer in your area who could tell you how much this might cost.
