Legal Question in Family Law in Texas

Divorced in 2012. One weekend when my ex had the kids I got drugged and raped at a bar. During ptsd I attempted suicide, got arrested twice for public intox, lost custody of my daughter, I only get her 1st, 3rd, 5th weekend. I have been in no trouble in 2.5 years. My ex a month ago caused a 7 car pile up. My daughter broke both femurs, right arm, bruised lung, lascerated liver. She's with my ex's sister now. Cps told my ex he will be getting her back. The night of the wreck he tested positive for clonapen, oxycodone and weed. Arrested for vehicular assault causing serious bodily injury to a child, illegal weapons and dui. How do I get her back? I've never hurt, neglected or put my kids in danger.

File a motion for modification that asks that you be awarded the exclusive right to determine the children's residence. Ask for temporary orders. Get your ex served. And take it from there.
