Legal Question in Family Law in Texas
I have been divorced for about 7 years now and have 1 child with my ex-husband. The attorney general contacts me every 3 years to see if I want to review my case and to see if I am due more child support. I recently took them up on it. I never had before because my ex-husband always promised to help with other expenses for our son but never has. He also has never carried him on his medical insurance or reimbursed me like our divorce decree says. Well he was served with a non agreed order on what he will have to pay for child support and medical. He hired a lawyer and is going to fight it. They are saying I only filed this to harass the respondent which is my ex husband. They are entering a general denial and asking I pay for all his court costs and lawyer fees since he hired attorney. The attorney general sent him a notice to show up at their office with me at the time the order was drawn up, but he never showed up. What are the odds that I will have to pay his lawyers fees??

While I cannot promise you or anyone else an absolute result, I would not worry about the Court assessing attorney's fees or costs against you. The paragraph asking for the other side to pay your attorney's fees is included in almost every family law pleading, but in the vast majority of the cases, each side will pay their own. You do need to know that in your present proceeding that the Attorney General's office does not "represent" you.
