Legal Question in Family Law in Texas

I have been divorced for 2 years. My ex-husband is attempting now to get custody of our son. Our son is 12 years old so he can decide, but my ex-husband was arrested 1 year ago for having 47 marijuana plants (valued at $70K) and he had growing equipment in his house (all of this the reason we are now divorced) and his sentence was just handed down in June of this year (2009) for 5 years deferred adjudication. Will a court still look favorably on him as being able to provide a suitable home for our son? What things will the judge look at?

First of all, a 12 year-old cannot decide where he wants to live. He can file a preference with the court, and it is a factor to be considered. His father's drug history is also a strong factor. It does not automatically disqualify him, as there are numerous factors to be considered in a custody case. A custody fight is not something you want to try to handle on your own - it is far more complex than it may appear at first. Please hire a lawyer.
