Divorce-House Foreclosure-Community property state

I seperated from my husband in July 07. Filed for divorce in Aug 07. Our primary residence was refinance in 2004 by my husband. The note is in his name only. He is allowing it to go into foreclosure. I am listed on the deed, in a community property state, I did not sign the promissory not but signed the following documents-Texas Home equity Security Instrument and Texas home equity fixed/adjustable rate rider. Can the mortgage company file deragatory credit on me if I am not listed on the note?
