Legal Question in Family Law in Texas

divorce,ssi,property

im on ssi-2004,husband guardian on ssi because of injuries. NOT power of attonery.he's cheated,physical abuse-we BOTH prefer divorce. We bought property in 2001-home & 10acres. ALL legal papers,deeds,etc IN MY NAME ALONE. Home & property TOTALLY paid for. Kids grown 19 & 23.

HOW do I have him changed from my guardian,how do i files for divorce & NOT be forced to sell home,divide property,etc with husband? thanks

You can change the guardian the same way you acquired your H as guardian - apply to the court by Petition to Terminate Guardianship and to Appoint Substitute Guardian. If you don't know how to do this, I suggest you contact a lawyer. The house and property is still 1/2 his in community property. You can buy out his 1/2 interest or maybe there's something else with similar value he would accept as payment rather than buying out his interest in the homestead.
