I have been separted for 3 years already, am I considered divorced or in what conditions am I right now?

Nothing in Texas law provides for an "automatic" divorce based on length of separation. You will remained married until one of two things happen:
1) One of you obtains a divorce; or,
2) One of you dies.

I a common law marriage, if you have been separated over 2 years, it is harder to prove that a marriage existed.
However, it is NOT impossible to prove that a marriage exists.
Therefore, there are 3 ways to get divorced in Texas.
I would not assume you are divorced.
