Legal Question in Family Law in Texas

DNA & Child support& Custody

I am a 31 year old male living in Tx. I was just served papers telling me that I have a 13 year old son(whom I have never known about)requesting back child support and medical support. How in the world could this be? I was 16 when I ''went steady'' with this girl. I never knew she had a baby much less that it could be mine. Why now can she come and serve me with this? I am mad and sad at the same time. If this boy is indeed mine can I counter sue for fraud or something, I have been robbed of 13 years with my son. I want to have the DNA test done before this hearing in Feb. Can that be done? Please what can I do here? I need help. Thanks,

Re: DNA & Child support& Custody

You can request a DNA test. This request is usually done at first hearing and after the results, a second hearing is scheduled.

If the child is yours, then issues of support, vistation and access will have to addressed.

With regard to a counter-claim for fraud, that is not possible. It will be a factor however with regard to whether back child support is issued.

Hope this helps.
