Legal Question in Family Law in Texas
DNA results show my son is not the real father of his daughter.
My son has been on and off involved with a girl for three years, for about the last year and a half they have mostly just lived as roomates. Both off and on dating others, she got pregnant and there was the possibility it was his, and she swore it was his. We all went through the pregnancy, birth and have a beutiful grandaughter. He did not sign the birth certificate, but she has our last name. My son had a DNA test done without the mother knowing and now 3 months into this we have found out the baby is not his. The mother and baby live with him, although in separate bedrooms, and he does prob. 90% of the support of household. She does work also. Real father is unknown, my son is wrestling with what to do, If he confronts the mother without a plan, she may just leave with the baby, and he is attached. but unsure about pursuing the adoption route. I guess we just need to know the options, Thank You.

Be sure he keeps a copy of the DNA tests somewhere safe. He needs to keep the original away from where he is living and NOT in his vehicle. He should leave it with you or with someone that keep it safe.
He is not a biological parent. They are not married. They are roommates. He has no parental rights. He can sue and fight for some limited parental rights. It would be a tough fight. Our office would charge him $5,000 to start such a case since it's going to be a difficult and expensive case to fight. It could VERY EASILY run much more than $5,000. He should be prepared to pay $10,000 or more.
If he lives in Harris County, he can call my office for a free phone consultation.
