Legal Question in Family Law in Texas

How can I get dna testing enforced

i am having a hard time getting the ag's office to enforce dna testing, the children in question are 20 and 17 1/2 now. i have not seen the oldest one for over ten yrs.now and the other one only once. the mother and i was married and seperated before the youngest one was concieved, we were living in different states then . she came back to tx. and filed for a divorce outside of harris county. at that time i was living with my girlfriend, i have papers proving now that she signrd for a citation for me to appear in court for the divorce. i never had seen these papers before, until i sent for them. the mother of these children told me the youngest child was not mine and she was doubtful that the oldest one is. she also told me that nothing would ever legally come out of this. . .i have appeared in court and asked for it to be transferred to the county in which i live and dna testing done.the mother has not appeared in court, and they tell me that they cannot find her to serve the papers. how can this be?appearently she is getting money and irs income refunds from me.

You need to make a written request for the test with the Court in which this action is pending. I doubt that the proceedings will be transferred to your home county. But, you could have the test performed in your home county and ship the results to the county in which the proceedings are being conducted. I don't know what kind of "papers" they are trying to serve on the mother, but if she wants to pursue this matter, she will have to show up in court; or the case will be dismissed. Make sure that you maintain contact with the Court and check regularly for current proceedings.
