Legal Question in Family Law in Texas

Domestic abuse and family law

I am thinking about leaving my abusive spouse, and return with my two children to Massachusetts (we currently live in Houston, TX). I worry about the legal implications of leaving the state - what should I do? Must we stay in Texas?

Since it will be some time before you can establish residency in Massachusetts and be able to file for divorce and custody there, you really should talk with a good Texas family law attorney before you take the children out of the state. The Houston area has several places you can turn for help so you do not have to stay with your abuser.

If there is no petition for divorce and no orders in place then there is nothing legally preventing you from leaving the state. May God bless you and your children.
