Legal Question in Family Law in Texas

domestic assalt

My boyfriend and I got in a fight where he ultimately punched me in the face. After doing so, I attacked him. He called the police to have me arrested for domestic abuse. Upon further investigation by a detective, he was found to be the abuser and myself the victim because he punched me. He has since gotten arrested and charged. He promises though, to have me arrested too because I hit him as well. Can he do this? Or am I in the clear because the detective ruled me the victim? Does the DA still have a say in the matter? Can I still be in trouble?

Re: domestic assalt

Yes the DA has a say in the matter, in fact, a major say in the matter. If the ADA believes you were purely a victim, then you are not in trouble, but if there is an issue with the ADA about the assault, then you might still face charges.

You should consider hiring a lawyer to test the waters for you.
