Legal Question in Family Law in Texas

Domestic Violence

Recently, my ex-spouse and her husband had a falling out. He attempted to shoot her, but she was able to stop his attack by beating him with a toy scooter. I am in fear for my childrens lives, and do not want to return them to her. Unfortunately, she is the custodial parent and I am the non-custodial, what can I do to protect my children? Neither one of my children want to go back with her, but she keeps insisting that I release them to her, help???

Re: Domestic Violence

You need to file a motion to modify your custody/possession and access order immediately. You can even get an emergency order if the facts of your case meet the requirements. You should make contact with an attorney immediately to discuss the relevant issues (ages of your children, the evidence against mom and the danger the kids are in, etc.) to find out what you can do. The sooner you act the better. If you wait too long you take the sense of urgency out of your case.
