drug addict mother wants custody back

In my fiance's divorce, the decree stated that he can have his ex randomly drug tested, because she is a known drug abuser. Because he is in the military and was on deployment during the time of the first hearing he didn't win custody of his two kids. He came back, drug tested her, she poped posivitive. Custody now revierts back to him untill the time of a hearing. Now that we have the kids we've found out that - their shots have not been updated in two years, they've never brushed their teeth, they were allowed to watch shows like south park and 2 & 3 years old! They've never eaten anything heathly in their life, putting them slightly over weight. Also there has been no disipline in their life at all. Things are starting to look up for the kids, but we are worried that she'll get them back. what are her chances of winning? does the fact that we aren't married and going to have a baby soon make a difference if we have a save healthly home established for them?
