Legal Question in Family Law in Texas
Drug Testing my teenage son
I have a 16 year old son that is failing school. He is already almost two years behind in school. I was told by one of his friends' mom that he has been smoking pot. I have talked to a few of his teachers and they say that not only is he flat out not doing his work in class, but sometimes he only wants to sleep in class. I was thinking about having him drug tested at his pediatrian's office. I also have a 7 year old daughter and I wanted to know if his test comes back positive I be in any trouble. I am a single mom and not real sure how to handle this. Can you please advise me as to how to handle this without having anything affect my daughter.

Finding out is he is taking drugs is part of the battle; then getting him to do something about it is another part.
I wouldn't worry about the ramifications of a positive test on your son with regard to your daughter. As long as your son is not a danger to her, there is no grounds for CPS action. In fact it would reflect better that you are taking steps to acknowledge and address the situation with your son. You can let him know exactly who will be needing to move out if he creates a problem for your daughter; she's not the one making dumb choices.
