Legal Question in Family Law in Texas

Durable Power of Attorney

Just downloaded above form for my 84 yr old mother to sign. She is healthy and still mentally competent. She is also on a fixed income. The problem is her 59 yr old boyfriend who is unemployed most of the time.

The questions are:

1. In case they decide to get married, can he, as the husband void this durable PofA?

2. Is my mother responsible for his debts (credit cards, car loans, etc) even if she did not sign any loans herself while married?

Thanks.

Re: Durable Power of Attorney

There is no form to look at, but even if there was you and your mother would be much better off going to an attorney. Durable Powers of Attorney are usually inexpensive.

A trip to the attorney will give you a chance to ask your questions of someone who can get enough information from you to be able to give informed answers, and who can make suggestions based on the situation and your goals.
