Legal Question in Family Law in Texas
Emancipation? Or What?
We adopted a child when he was 4yrs, now he is 16 and we're having many issue/concerns with him. We checked with the agency where he was adopted for information on emancipation and they said they didn't know how to do this. My sister took him to stay with her a little while(1month in the adoption state) and is having major problems with him. Child services won't take him. What do we do? (trying to shorten this). We want to have him emancipated and remove our name. He is 16yrs. I've called the agency here in texas,no help or return calls and same with the adoption state. help

Re: Emancipation? Or What?
He's not a puppy you can send back to the pound. Do you have any idea how unfeeling you sound? Wanting to "remove" your name? Trying to force his emancipation? Trying to get CPS to take him? He is your child, the same as if he had been born to you.
Re: Emancipation? Or What?
This is your child, period. It doesn't matter what state he was adopted in, or especially even that he was adopted. You also cannot force an emancipation on a child. He is your responsibility until he becomes an adult. You solution is to continue seeking help for him.
Re: Emancipation? Or What?
I absolutely agree with Theresa Langford.
You are the child's parents!!
You are liable for him until he is 18.
No court in Texa is going to emancipate this child. There are limited grounds on which to emancipate a child. One is that he is self sufficient and supporting himself.
Where you adopted him is irrelevant. I assume you all live in Texas. You are Texas residents and TX law applies.
Just because he's having problems, no adoption agency is going to help you now.
