Legal Question in Family Law in Texas
Emancipation and Child Support?
I am 17 years old and living in Maryland with my mother. My dad is currently paying child support. If I get emancipated from my mother, would my father have to pay me child support? I am asking this because I have looked up the laws for both states, and I can't get emancipated from my father because I don't live in Texas. Does this mean that he would still have to pay child support since in Texas I would still be considered a minor? Also, I have a car that is in my mother's name since I am still a minor. She didn't pay for it, it was given to me by some family friends. Would I be able to keep this if I get emancipated, since they gave it to me; or would my mother be able to keep it since it's in her name? I would need it to get to and from school since I go to a private high school that doesn't provide bus service and I go to college at night and I would need to drive there as well. Would I be able to keep my car because of this? Thanks.

Re: Emancipation and Child Support?
Firstly, I cannot advise you as to Maryland law. Your father's obligation to provide child support is written in the divorce or SAPCR decree. Emancipation is a legal condition that applies to you, not the parent. Under most Texas decrees, a parent's obligation to support ends if a child becomes emancipated. Again I do not know Maryland law, however, it is unlikely that a court will force your mother to title the car to you. Your best bet is to get her to do it voluntarily. TCL
