Legal Question in Family Law in Texas

emancipation of minor early

my granddaughter is 17 and having a very difficult time with her mother and stepfather. Is it true if she lives with her father and pays him rent she can be emancipated? She is working part time and going to school.

Re: emancipation of minor early

It is possible. It depends upon the specific facts. Her mother will be entitled to notice of the petition, and has the right to contest it. As an alternative, her father can file for modification of conservatorship. Since she is so close to 18 anyway, the mother may choose to not contest the change.

A consultation with an attorney will give all of the affected persons a clearer idea of the options and the costs.
