emanicipation
My son's girlfriend is 16 going on 17 in dec. and is pregnant with my granddaughter. Her parents are trying to take this infant away from her when its born. The mother to be wants the child to come live with my son, his parents.
The mother to be would like to see about getting emancipated. so that her and my son can be a family.
The mother is not understanding on this matter.
She says she already has custody of the baby without any consent from either parent of the unborn child.

You need to hire a lawyer to represent your son. As the biological father of the child, his rights are equal to hers, but has to have a method to enforce those rights. A Suit Affecting the Parent-Child Relationship is appropriate avenue.

Legal emancipation to get married because of pregnancy is not likely. The baby belongs to the girl. Her mother does not have custody without a court order. Someone could file a Suit Affecting Parent Child Relationship for the pregnant minor to have custody taken away from her mother so that the child could have her child without interference. Sounds expensive to me. Good Luck.
