Emergency Custody

I recently sent my children to visit their grandparents in Euador. It's nearing time for them to come home and the grandparents called me and told me that they were not sending my children back. I am at a loss as to what to do. I spoke wuth the State Dept. who said I could go through the Hague Convention to get my children back, but that I have to file for emergency custody of my children. How do I do this without having to serve the father? ANd I was also told that some states have a law that was automatically put into place that if the parents were never married then the mother automatically has sole custody, does Texas have something like this? Father was deported and resides in Ecuador. PLEASE HELP!!!!

I would hope that you could see that this matter is much too complex to address over the internet in e-mail messages. If you ever want to see your children again, you better find a lawyer who has succeeded in this type of case before and recently.

As an attorney with extensive immigration experience, I echo Mr. Grissom's advice. You need to be a lawyer's office first thing tomorrow morning. It should be an attorney with excellent experience in all of the issues you confront in this situation.
