how do I get an emergency restraining order to keep my ex from moving out of the state tonight in violation of our custody agreement?

Do you have an agreement or an order? A written agreement is evidence of his intent at the time it was signed, but has no validity of an order. In either case, you need to retain an attorney immediately, as you are in the middle of a complicated situation. An attorney will petition the court to return the child. The type of petition and proceeding will depend on what, if any, orders have already been entered. You need to act quickly - in some situations, jurisdiction attaches by who gets to the courthouse first.
