Legal Question in Family Law in Texas

An engagement ring is a gift given in return for a promise of marriage. If you offered the engagement ring to your fiance in exchange for her promise to marry you, and then you ended the engagement, then she is not required to return the engagement ring to you.

This was your response to a question I posted. What about if it was a mutual breakup? To me it was 100% mutual and in her efforts to keep the ring she is saying I was at fault for the breakup.

Even if it was mutual, it's not her fault.

But if this is a big deal to you (and maybe it should be if it's a really expensive ring), then sue her in small claims court for breech of contract and see what happens. It won't cost you much to try your luck there and, who knows, maybe you'll win!
