Establishing Conservatorship/Custody
How does my daughter legally establish conservatorship/custody of her 5 month old baby? She is 17 years old, still in High School, in 11th grade & works part time. Her boyfriend and his parents tried to take the baby from her last night and police were involved and recommended she legally establish custody/conservatorship. The boyfriend is homeless/jobless and not in school. His parents kicked him out just after the baby was born when they found evidence of his drug use. My daughter pays for the babysitter while she is in school, buys the diapers/wipes and is currently in the W.I.C. program to provide formula for the baby. The other grandparents are well off, contribute nothing, and I am concerned they will hire a high priced lawyer to obtain custody of the baby. My daughter is a very good mother. She is capable of making most decisions. Her boyfriend is very pursuasive, but she does not want to live with him and his family. He has been in trouble with the law several times over different matters, has anger management problems and hasn't held down a steady job ever. We want to do what is right for the baby. My daughter and the baby live here in my home with my family. I work full time as an Assistant Manager for Jiffylube.

Custody of the child is determined in a legal proceeding in a court. The legal proceeding is called a Suit Affecting the Parent-Child Relationship. If the boy's parents are trying to manipulate this situation using the police, I suggest you contact contact a lawyer in your area ASAP. The boy's parents can initiate the Suit Affecting Parent-child Relationship also. There is no presumption that merely because your daughter is 17 years old that she is not a qualified parent -- but this will have to be proven before the judge. It's for this reason that I urge you to contact a lawyer.
