esuming

what are the legal rights of dececed persons family when it comes resuming and movig a body from one state to another. my sister was shot b her husband in 1984 and we would like to bring her back to kansas to be burried next to her mothe.

I've never had this question asked before!

I assume that the person that paid for the plot would control. You would need to contact the cemetary and see what they require to dig up the casket. I would expect it to cost several thousand dollars (I could be wrong) to dig it up and ship it out of state. There might be laws regarding shipping from one state to another - you would need to ask this question.

If someone objects to the casket being moved, then it would be decided in Probate Court in Texas.

I did not have many details, so my answer is very genetic and general.

If you need to retain the services of an attorney, I recommend a probate attorney.

I can recommend 2 in Houston --

I have used and often refer to Kevin Alter located in the Museum District in Houston, Texas.

I don't have his phone number or address with me.

You can go to the State Bar of Texas website and look under attorneys -- there can't be that many Alter's in Texas.
