Legal Question in Family Law in Texas

My ex-girlfriend is pregnant with my child. We are not married. She all of a sudden quite communicating with me. She won't answer my text messages or mine or my families phone calls. I simply won't to check on the status of our child who is due the last of August. What do I do? Should I talk with an attorney at this stage of the game? I would like to have a paternaty test done if make sure it is my child. What legal right do I have?

Unfortunately, at this point, you really have no "legal rights" to the child. However, you can fix that. You need to file a Motion to Establish the Parent-Child Relationship. Once that relationship is established, you can ask the court to issue orders regarding conservatorship of the child, possession of the child, and the like. The Texas legislature (and resulting statutes) are very dad-friendly and recognize the importance of a father in the life of a child.

Until then, though, there's just not a whole lot you can do to get mom's cooperation. I suggest you move forward with establishing your relationship with the child so that you can be involved in his or her life right from the start. Good luck to you, and congratulations Dad!

I would find an attorney that you plan to hire so that you can file your paternity case as soon as the baby is born.

You need to recognize that you are dealing with a pregnant woman. You need to be nice to her. Have you sent her flowers lately? Have you sent her a nice card lately? Have you sent her a a huge basket filled with "baby things" that she will need when the baby is born? If you don't know what she will need go to Target and just walk up and down the baby isle and buy a bunch of "baby stuff" - diapers, wipes, shampoo, gowns, towels, blankets, etc. Babies need a lot of stuff!

Be nice to her -- it will save you a lot of money in the long run. The next couple of months is going to be difficult for her and she is going to be more and more difficult to deal with - she is physically miserable and it's hot outside - so be nice to her.
