exhusband is trying to take custody

My ex husband is trying to get custody of my 13 year son. In our agreement he would live with me until the age of 18 with his dad pay child support and vistion rights . I would like to know what my rights and the procedure he would have to go through to get his case in court . My son does not want to go live with him , he wants to live with me will that have anything to do with the courts decison .

At the age of 13, your child's choice will have a lot to do with the judge's decision. The father would have to show that the change would be in the best interest of the child. If the child says no, that would be a good indication of what's best for the child unless there is something bad wrong with your situation, i.e. substance abuse, bad habits, etc.

If bad things are not happening, then I don't know how the father could succeed. You will need a lawyer to help you if he makes the effort, however.
