Legal Question in Family Law in Texas

My ex-husband and I have been divorced for over 3 years. Our son is 4yrs old now and he hasn't seen him since he was born, does not want to either. He has been asking me to sign over his rights. I have no idea where to start or if this is something he has to do.

Either parent can file a petition with the court that asks for termination of the father's parental rights. In connection with the petition, Dad signs an affidavit of relinquishment of parental rights. It is then up to the Judge as to whether or not he will sign an order terminating Dad's parental rights.

I have seen two cases where Mom wanted termination and Dad wanted termination, but the Judge said "No." He decided that it wasn't in the child's best interest for Dad's rights to be terminated.
