Ex-step son wants to live with me

My ex-step son (his dad and I recently divorced in July 2006) wants to come live with me. He is 13, I was his step mom since he was 5 and I did not adopt him. His dad is agreeable to him living with me but doesn't want to give up legal custody. What are our options? I want 'custody' until he finishes high school. His dad wants to be able to 're-evaluate' the agreement at the end of each school year in case his living situation changes (such as moving out of town/state).

Custody is only one way to gain possession of the child. If he doesn't want to agree to a custody arrangement, you could seek a guardianship. This must be done in court - notorized letters won't do it.
