Legal Question in Family Law in Texas

Extended summer visitation??

My ex-husband claims he post-marked a written notice for extended summer visitation on April 1st.

Court order reads ''If SWP gives EAO written notice by April 1 of a year specifying an extended period or periods of summer possession for that year....''

I never received this letter, he claims he saw our son take a notice from the front door in my house on April 2nd. I never received that or any other notice or the letter. He informed me May 31st at 6pm that he was going to exerscise his extended summer visitation--1st time i had heard of it?? I was going by court orders for standard summer possession. Now he claims he is going to file violation of visitation each day I don't give the children to him? He also admits the certified letter was returned to him May 2nd. He never notified me of this either, no telephone message or in person verbal message. My orders state ''written notice to be given'' to me by April 1st by him not the post office or my son with a notice for a letter on April 2nd.

What are my rights, does he have grounds to hold me in violation of visitation when I never received ''written notice'' by him or anyone on or before April 1st??

Re: Extended summer visitation??

It sounds like he is playing games with you. Send him a certified letter, correctly addressed, keep a copy and have the post office stamp your letter copy. Tell him that you never received the standard April 1 notice, therefore extended summer possession will correlate to the July provisions in the decree.
