Ex-wife moving out of state

My ex-wife is moving out of state with my son because her current husband has re-inlisted into the marines. Our divorce decree states that she cannot move out of the county or surrounding counties. Will the courts give her leave because of her husbands enlistment into the armed forces and who is responsible to pay for travel cost?

Unless you use the decree to stop her, the court will not know she is leaving. You better get started right now if you're going to have a chance to keep your son near you. Now is the time to fight for custody -- or let him go. Good Luck.

Assuming your decree has a geographic restriction on where YOUR SON can live, you MAY be able to use your ex's planned move as a basis to change custody or make other modifications. Find a good family law attorney and have him or her go over your decree with you and explain your options.
