Legal Question in Family Law in Texas

My ex-wife threatens to garnish my social security since I missed my last spousal payment. My divorce was finalized at the end of 1998 and I have paid spousal support for 30 months. What is worse I signed the document under duress and threat in a McDonalds, and without the privilege of a review by an able lawyer. Do I have any recourse?

Let's take the last question first. Threatening to do something the she could legally do is not duress. Of course, if she held a gun to your head that would be duress, but I doubt that she would do that in a McDonald's. The fact that you paid for two and a half years without complaint also diminishes any threat complaint.

You did not say how long the spousal support was supposed to run. Did you pay for thirty months out of the last 13 years? Was it supposed to run for 13 years? There are just too many unanswered questions.

You should get all of this information and go talk to a family law attorney.
