False names on marriage lic

I was wondering, if my spouse was using a false name or assumed name on the marriage cert.would our marriage be illegal? Presently, I am seeking a divorce. And I want to know was our marriage legal in the first place.

I only practice law in Texas. I cannot address CA law.

I've had similar problems come up in Texas divorces. Basically, I tell the client that they are married to the name on the marriage license and that there needs to be a divorce to that person.

While the name may not have been correct, I believe the court would decide that indeed you are married. Call to discuss 800-685-6950
