Legal Question in Family Law in Texas
Family Law Child Custody
The mother of my son's 2 boys recently died of AIDS. They lived together for the last 10 yrs, but never married. The maternal grandmother wants to take custody of the boys and move them to New Zealand or at best to Houston with other maternal relatives. We don't have money to go to court. What are my son's rights and do I have any rights as the paternal grandparent?

The grandparents of the deceased mother have standing to address these issues in court, and so does your son. It is his decision whether to agree to this, contest this, or negotiate a settlement he can live with. Your son will need a lawyer, and may want to consult with social services agencies about legal representation, if he cannot find a lawyer that he can afford.

There are free legal services in many counties for indigent people.
Unfortunately, they are usually overwhelmed with requests.
I highly recommend that you look around for an inexpensive attorney to help you. Many attorneys will accept monthly payments or discount their usual fees in order to make their services available to more people.
Ask your friends who they recommend or look around for a recently licensed attorney to help. Many newly licensed attorneys will take cases at a discount.
If you don't get involved, then anything could happen.
