Legal Question in Family Law in Texas

Family Law, child not developing in mother's custody.

My ex wife and I chose in November of '07 that it was not working, and in January of '08 she left to her parents 50 mi.s south, I stayed in the DFW area. Our son was 2yrs 6mos old in Nov '07. I reliably paid an agreed amount for support. Very soon after, she moved to houston on very short notice, and intentionally lost all contact with me. She regained contact with me when Hurricane Ike came (9/4/08), she asked me to watch him until power came back. I did, for 3 weeks. After this, I saw him 1 weekend a month. Then she lost her daycare & job and returned to living with her parents, went to every other weekend. We finalized the divorce in feb '09. Doctors say my son's speech and some mental ability is that of a child 2 1/2 yrs old (his age around when she left). He is an angel when at my house and she claims he is a bad kid when with her, and phone calls to her with him in the background show he is unruly but undisciplined. Now she is saying she will move back to Houston soon. Is there anything I can do?

Notes:

Mother has a history of self mutilation and mental illness

Where she is currently living, there are 5 people living (total) in a 2 bed 1/2 bath house of around 700 sq. ft., not one is employed.

You could file a motion to modify and seek a Temporary Restraining Order to keep her from leaving. Probably be a good idea to get an attorney. This is kind of complex for the uninitiated.
