Legal Question in Family Law in Texas

I seperated from my husband back in April 2007 and filed for child support through the attorney general. By the time we were called for the case we had reconciled and decided he would not pay child support only medical support. We have an order on file showing that I am the custodial parent. Since then we separated again and I filed for divorce on Dec 5, 2008. Since we will be filing our taxes, Do I have to let him claim any of our 3 children for 2008?
