Family Law Question

Single Mom. 2 kids in question. No father on birth certificates. Does the probable father have parental rights to my children? The probable father wants to sign any legal right he has to my children. He has left when finding out of pregnancy, denied both. No help financially or any other way. So what to do? Affidavit of Interest of the child says it should only be used with the child in question is to be adopted, in my case, no adoption is applied here.

First of all, no judge in no Texas court is going to approve any agreement for a father to walk out on his children on the facts that you present. Whether he wants to be a father, whether he is on the birth certificate, whether you want him to give up his parental rights - none of that matters. The only thing the judge decides is what is in the best interest of the child. And it is not in the best interest of the child for the father to sign away his parental rights even if he is not performing his obligations. What happens if he changes his mind sometime later? What you are talking about is just not going to happen.

Mr. Grissom is right. If you are absolutely broke - go to the Attorney General, they will handle the paternity and child support issues. (It is a slow process - but is better than nothing).
