Legal Question in Family Law in Texas

Family law and unwed parents

My daughter has a newborn and the father is around but they are not together. She put him on the birth certificate and wants him and his family to be able to visitthe baby. However, she is a college student and he is awaiting trial on an unrelated sexual assualt case. 1. Can she have sole custody and him just visitation rights?

2 Can she choose to only use her last name for the baby?

3. He has been indicted by the grand jury, but not yet convicted. Can she demand that he have only supervised visits?

4. I am ready to go forward with this so he will stop showing up at his pleasure and not at her choosing. WHat steps do I need to take ?

Get her a lawyer. It is a reasonable argument to make to the court that supervised visits are appropriate. The burden of establishing the allegations is much lower in family court than criminal court. In order to establish some order to this chaos, she needs a court order establishing child support, conservatorship, and visitation. Good luck.
