Soon to be ex wife wants custody of my nephew and the house
That is under the husbands name. Can she take those things even
Though there was no pre-nup?

The husband needs to hire an attorney. The wife can ask for anything. However, only a judge makes the decisions. If the husband owned the "stuff" before marriage it his usually his separate property. However, if the husband does not let the judge know that it belonged to him before marriage, then the judge could give it to the wife.
