Legal Question in Family Law in Texas

Family question

I have been married for 6 years. M y stepson lives with us and his mother has had no contact with him for almost 8 years. My husband past away this week. Whats going to happen to my stepson? We are very close and he has been with us seen he was 3 years old? I have not adopted him because we have not been able to find his mother. Will the court take him from our home and away from me.

Why not adopt him now? His mother *can* be found or a notice published in the paper. Now that his father has passed, you would be the best one to take care of the child, but you have no familial relationship. You have no legal relationship with the child unless you take some action for the child. No Court will seek you out to take the child. Find a lawyer. Many lawyers take payments on these situations if that is a factor. Good Luck.
