Legal Question in Family Law in Texas

Family Violence:

I am not clear on what I can ask for in child support. The Lawyer says 30% of net salary but my husband(separated) takes out pretaxed monnies for savings and retirement. Am I entitled to a % of this. Also should i change lawers if my current one isn't fighting for me. I am afraid of my husband so I am not being "combative" signed scarred

Re: Family Violence:

Child support is based upon "net available resources" - generally, salary less 1 income tax deduction and union dues. Thus, you ex-husband's deductions will not be a factor in calculating child support. If you are not satisfied with the service of your attorney, fire him. A lot of attorneys will advocate your position because it is the law and they try to win a case because it is their nature. Try to find someone like that.
