father not on birth certificite

i recently got married and my husband and i have been togeher for three years. he is the only father my son has ever known. i want you know if i have to get the concent of the bio-logical father of my son who has never been in my sons life and is not on his birth certificite for my husband to adopt him?

Retain an attorney -- as you do not want to risk any errors in these proceedings. You will file a Petition to Terminate the Parent-Child relationship simultaneously with the step-parent adoption. The biological father may or may not agree with the proceedings. It will be smoother and less expensive if he does agree. Good luck. TCL

The biological father must be adjudicated that he is the father first then you can proceed with termination and possible adoption.
