father to change child's last name

My son is 2 and a helf years old and to date has had no support or visitation from his father at the father's choice. Recently he has taken this to the attorney general and may be granted supervised visitation including child support. The lady there told him that with him paying child support he gets top decide wether my son has his last name or mine, as to date he has mine. There are many reasons he may not get any visitation but what I want to know is: Will his paying child support give him this free right to change my son's lat name?

You need to hire an attorney to represent you.

Usually the courts will allow the father to choose the child's last name. It is, however, a matter that can be negotiated if the parties will cooperate.
